Reimbursement for Double-Payment of lighting fees by the HOA and Duke Energy Progress

Residents of the Tralee Subdivision in Smithfield, NC recently discovered in December of 2021 that they were being double charged for lighting by both the HOA and by Duke Energy Progress for a period of over 5 years. As of 2/15/2022, the HOA has made the stance that they will not be giving reimbursements to those residents because it was not done in "error" however, per the documents every resident had to sign when purchasing their homes, the HOA is responsible for the mainenance of lighting fixtures and the cost associated with that is included in our HOA dues paid by every resident, every month. The fact that these charges were never turned over from one group to another many years ago is irrelevant because the documents signed, indicates that they were responsible.
