PETITION FOR THE URGENT ENFORCEMENT OF AN EVICTION ORDER AND THE PROTECTION OF RESIDENTS

Subject: Request for the Urgent Enforcement of an Existing Eviction Order and Protection of Residents Due to Safety and Security Concerns
We, the concerned residents of Bluewater Bay, Ward 16, hereby respectfully submit this petition requesting the urgent enforcement of an existing eviction order and the removal of the occupants residing at 21 Christelle Street, Bluewater Bay.
This request is made in the interest of public safety, the protection of affected families, and the restoration of peace and security within the community.
Our request is further informed by the fact that the current occupant is not the legal owner of the property and there is an ongoing dispute between the occupant and the lawful owner, which has hindered objective engagement and meaningful mediation regarding the current circumstances.
This petition is based on the following grounds:
1. A police investigation is currently underway concerning the death of Mr Ndwalaza, whose parents reside at 19 Christelle Street, Bluewater Bay.
2.According to the police report, the matter was registered under Case Number 142/04/2026 at Swartkops SAPS.
3.The circumstances surrounding Mr Ndwalaza's death remain under official investigation, and an inquest has been opened.
4.The continued presence of the neighbouring occupants at 21 Christelle Street has created fear, anxiety, and significant safety concerns for the bereaved family, potential witnesses, neighbouring residents, and members of the broader Bluewater Bay community.
5.Given the existing eviction order issued in 2025, the unresolved occupation of the property, and the ongoing police investigation, residents have legitimate concerns that the property may continue to be associated with activities that undermine the safety, wellbeing, and peaceful coexistence of the community.
6.In order to protect the wellbeing, security, and peaceful enjoyment of the neighbourhood, and to promote social justice and public confidence within the Bluewater Bay community, we respectfully request that the relevant authorities take all lawful steps necessary to enforce the existing eviction order and facilitate the removal of the occupant in accordance with applicable South African law.
We respectfully request that:
•This matter be treated as urgent and be considered within seven (7) days of the submission of this petition.
•The relevant authorities expedite the enforcement of the existing eviction order granted in 2025 and take all lawful steps necessary to ensure compliance.
•Appropriate legal procedures be followed to prevent any potential intimidation, harassment, or interference with witnesses and affected parties.
•The safety, wellbeing, and rights of the bereaved family, neighbouring residents, and all affected community members be prioritised throughout the process.
•Any additional protective measures deemed necessary by the relevant authorities be implemented to preserve public safety and maintain peace within the community.
We wish to emphasise that this petition is based on legitimate safety concerns and ongoing investigations and is not intended to determine or imply guilt or innocence, which remains solely the responsibility of law enforcement agencies and the courts.
We submit this petition in good faith and in the interest of protecting the rights, safety, and wellbeing of all residents of Bluewater Bay.
