Concerned Attorneys

We, the undersigned are licensed attorneys from various backgrounds, bound together by our oath to support the United States Constitution. We are united in our concern that the current administration of President Donald Trump has repeatedly threatened the basic tenets of our constitutional form of government, claiming unprecedented executive powers, and violating settled statutory and constitutional law. His troubling actions include the following:

First Amendment Violations

  • He has threatened law firms based upon the clients that they have represented by suspending their security clearances, excluding them from government contracts, and restricting their access to government buildings.  

  • He has threatened the funding of universities because of their viewpoints.

  • He has directed his Federal Communications Commission to threaten broadcasters and late night television shows because he disagrees with their viewpoints.

  • He has revoked visas of those lawfully in the United States solely because of their expression of viewpoint with which he disagrees.  

  • He has called for media companies to have their licenses revoked because they criticized him.  

  • He has publicly criticized judges for ruling against him, calling, without basis, for their impeachment.

  • He has urged the firing of persons for conduct that was lawful and expressive.

Due Process Violations

  • He has urged the Justice Department to prosecute his political opponents, successfully prompting the DOJ to pursue politically motivated prosecutions rejected by career prosecutors.

  • He has attempted by Executive Order to deprive those born in the United States of their citizenship, in violation of statute and the Fourteenth Amendment.

• He has deported persons he claims to be gang members to El Salvador and other countries without trial or hearing, without due process; when courts blocked such removals, he attempted to proceed regardless.

  • He has used the military to kill civilians in boats outside the U.S. in international waters, in violation of international law.

Separation of Powers Violations

  • He has impounded funds appropriated by Congress, in violation of law and separation of powers.

  • He mass-fired 17 Inspectors General to avoid oversight, without providing Congress the statutorily required notice.

  • He has engaged in mass firings of the executive branch without congressional authorization, in some cases eliminating government offices (by eliminating nearly all employees) exceeding his authority.

  • He has attempted to usurp the tariff power of Congress and claimed the right to arbitrarily tax or impose tariffs without legislative authorization.

  • He has directed the Election Assistance Commission to require proof of citizenship on federal voter registration forms, effectively altering voter registration law without Congress.

  • He has attempted to exclude undocumented persons from the census-based apportionment process, contrary to constitutional and statutory norms.

  • He has employed the military against citizens for domestic purposes without legal justification; when ordered to desist, he has attempted to circumvent court orders.

  We condemn in the strongest possible terms the unlawful and unconstitutional acts of this administration. We are concerned that he seeks to set up an authoritarian form of government foreign to the American democratic ideals. We urge all people of good will to remain united, and peacefully but unequivocally resist within the bounds of the law these attacks upon our constitutional government and our freedom.
