Petition Regarding CAM Charges, Financial Transparency, and Non-Compliance Issues

Subject: Formal Petition Regarding CAM Charges, Financial Transparency, and Non-Compliance Issues

Respected Sir,

We, the undersigned residents and co-owners of units at Siddha Suburbia, hereby issue this formal petition on behalf of the general body of owners, addressing significant concerns related to Common Area Maintenance (CAM) charges, financial misstatements, lack of transparency, and procedural lapses in facility management.

This petition follows repeated verbal and written requests that have not resulted in satisfactory action and seeks immediate redress and compliance with mutually agreed terms, financial norms, and fair practices.

 

1. Acknowledged Financial Discrepancy in Auditor’s Report

 During the official meeting held on 7th April 2025 at the Skyward Office (Sector V, Salt Lake, Kolkata – 700091), your appointed auditor accepted and acknowledged discrepancies totalling ₹5,36,997.00 in the balance sheet presented. Upon recalculation, the applicable CAM charges stood corrected at ₹1.61 per sq. ft., with retrospective effect.

 Any attempt to revise CAM charges without concluding the agreed financial reassessment constitutes a material breach of trust and will be formally contested. 

2. Conditional Agreement on CAM Charges

 It was mutually understood and agreed that the revised CAM charges would apply as of now until further formal Audit report will be placed, pending a full financial review scheduled for June 2025. Any unilateral hike or adjustment prior to the said reassessment will be considered void, coercive, and unacceptable.

3. Demand for Segregated Defaulter List

 Despite multiple requests, you have failed to share a segregated list of CAM defaulters distinguishing between:

(i) Owners who have raised legitimate complaints/issues, and

(ii) Owners with pending dues and no objections raised.

 You are hereby directed to furnish this list immediately to facilitate equitable recovery efforts and avoid collective penalisation.

 4. Mandatory Disclosure of Financial Records

You are legally and contractually obligated to provide the following financial documents without delay:

Detailed breakdown of all CAM-related expenses for FY 2024–2025, along with supporting invoices, vouchers, and receipts.

Updated and corrected balance sheets for FY 2023–2024 and 2024–2025, duly signed and attested by the auditor.

Updated inventory of sold and unsold unitsacross towers that have received Occupancy Certificates (OC).

Complete details and bank statement of the Corpus Fund including interest earnings, if any. 

5. Notification of Independent External Audit

 Due to persistent discrepancies and lack of financial transparency, we hereby notify you that an independent external audit will be commissioned covering FY 2023–2024 and FY 2024–2025.

You are required to extend full cooperation by granting access to all books of accounts, agreements, vouchers, receipts, ledgers, and internal correspondence as may be required by the appointed external auditor.

6. Mismanagement of Corpus Fund

 As acknowledged in prior meetings, an idle corpus fund of approximately ₹76 Lakhs remains uninvested. This constitutes a gross mismanagement of association funds, especially when such idle capital could be generating interest to subsidise CAM charges. Immediate steps must be taken to:

Invest the corpus fund in low-risk, interest-bearing instruments, and
Clearly disclose investment and withdrawal policies to the general body.
Since the details of the corpus fund have not been provided, we will consider it as part of the working capital, and accordingly, interest at 12% will be added under the earnings section of the CAM.

7. GST Waiver via Company Restructuring

 The decision to change the nature of the managing entity to waive GST on CAM charges was agreed in principle. However, no action has been taken in this regard despite repeated assurances.

 You are hereby instructed to provide a clear roadmap with timeline for implementation of the GST exemption strategy. 

8. Non-Issuance of CAM Bills Since April 2025

There has been no generation or distribution of CAM bills since April 2025, creating significant confusion among residents. We demand:

A formal explanation for this delay, and

An immediate commitment on when updated CAM bills (April onward) will be issued.

Final Note & Legal Reservation

Please be advised that all CAM payments will be continued in good faith, subject to resolution of these legitimate grievances and restoration of financial transparency. However, further non-compliance, misrepresentation, or unilateral decision-making shall leave the owners with no option but to initiate appropriate legal and regulatory action

This petition is being formally recorded, and a signed copy will be submitted to the legal counsel of the Residents’ Association as well as to the RERA Authority, if necessary.

You are requested to treat this as a final and formal demand for immediate corrective action.
