Introduction:
We, the undersigned residents and stakeholders of the City of Tshwane, urgently call on the Executive Mayor, City Manager, and Speaker of Council to immediately constitute the Strategic Land Development Tribunal (SLDT), as required by the Spatial Planning and Land Use Management Act (SPLUMA), 2013 (Act 16 of 2013).

The SLDT is a legally mandated decision-making body that considers critical land use applications — including rezoning, township establishment, and restricted access areas that improve community safety. Its continued absence in Tshwane is unlawful and severely undermines efforts to ensure spatial justice, service delivery, and public safety.


⚖️ Why This Matters:

  • Tshwane has failed to comply with its obligations under SPLUMA, specifically Sections 35–37, which require the City to constitute and maintain a properly functioning tribunal.
  • This failure is blocking legal, well-motivated development applications across the city, including:
    • Community-led safety upgrades.
    • Small-scale infrastructure projects.
    • Applications for improving land use in line with local planning frameworks.
  • The current administration’s refusal to constitute the SLDT is politically motivated and puts residents at risk by delaying lawful processes.

🏛️ Our Demands:

  1. That the Executive Mayor of Tshwane, the City Manager, and the Speaker of Council urgently take the necessary steps to constitute the SLDT without further delay, in accordance with SPLUMA and applicable municipal procedures.

  2. That the Gauteng MEC for COGTA issue a formal directive under Section 34(1) of SPLUMA compelling the City to comply, should political obstruction continue.

  3. That all future SLDT-related processes be depoliticised and managed in line with national planning legislation and constitutional obligations to ensure fair, transparent, and timely development decisions.
